Terms & Conditions of Service

1. Scope of Services

Subbie Help Desk provides masonry quantity take offs, Bills of Quantities (BOQs), 2D markups, 3D models and quantity measurement services based solely on the drawings and documentation supplied by the client.

Our services are strictly limited to quantity measurement and visual representation of masonry works.

Unless specifically agreed in writing, we do not provide:

  • Pricing or cost estimating
  • Labour or productivity calculations
  • Material pricing
  • Tender strategies
  • Procurement advice
  • Construction methodology
  • Engineering advice
  • Architectural advice
  • Financial advice
  • Legal advice
  • Project management or certification services

The client remains solely responsible for pricing, preparing and submitting their tender or quotation.

2. Documentation

All take offs are prepared using the drawings and documentation supplied at the time of engagement.

Subbie Help Desk accepts no responsibility for:

  • Missing drawings
  • Incorrect or incomplete documentation
  • Superseded drawing revisions
  • Design changes issued after completion
  • Errors or omissions made by architects, engineers or consultants

Where information is incomplete, inconsistent or unclear, reasonable industry assumptions may be made to complete the take off. These assumptions will generally be noted within the take off or accompanying correspondence.

3. Client Responsibility

The client is solely responsible for reviewing and verifying:

  • Quantities
  • Dimensions
  • Specifications
  • Engineering requirements
  • Drawing revisions
  • All assumptions noted within the take off

before:

  • Ordering materials
  • Pricing the project
  • Submitting a quotation or tender
  • Commencing construction

Subbie Help Desk provides quantity measurement services only.

Final responsibility for the accuracy and suitability of all quantities remains with the client.

4. Accuracy

Every reasonable effort is made to prepare accurate take offs using the information available at the time.

Construction documentation frequently changes throughout the tender process and may contain inconsistencies, omissions or errors beyond our control.

Clients should always review the take off against the latest issued drawings before pricing, ordering materials or commencing construction.

If an error or omission is identified, Subbie Help Desk’s obligation is limited to reviewing and, where appropriate, correcting the relevant quantities.

Subbie Help Desk shall not be liable for any costs associated with material purchases, construction delays, tender losses, loss of profit or any indirect or consequential losses arising from reliance on the original quantities.

Subbie Help Desk does not warrant that third party documentation is complete or accurate.

5. Quantity Tolerance

Depending on the quality and completeness of the documentation supplied, quantities may vary from the final construction quantities.

As a general guide, an overall variation of approximately 5% to 10% may occur where assumptions are necessary or documentation is incomplete.

6.Revisions

Minor drawing revisions issued shortly after completion may be reviewed at our discretion.

Major design changes, additional revisions or scope changes may incur additional fees.

Unless otherwise agreed in writing, the original quoted fee does not include measuring revised drawings issued after completion.

7.Independent Estimating Service

Subbie Help Desk operates as an independent estimating consultancy.

Unless an Exclusive Service Agreement has been agreed in writing before work commences, Subbie Help Desk may provide independent quantity take off services to multiple contractors tendering the same project.

Each engagement is completed independently.

All client pricing, commercial information, supplier information, margins and tender strategies remain strictly confidential and will never be shared with another client.

8. Confidentiality

Protecting our clients’ information is fundamental to our business.

Subbie Help Desk will never disclose or share:

  • Tender pricing
  • Labour rates
  • Supplier pricing
  • Material pricing
  • Profit margins
  • Tender strategies
  • Commercial discussions
  • Internal correspondence

with any third party unless required by law.

Where multiple clients engage us for the same project, only quantity measurement services may be provided.

No client specific commercial information will ever be disclosed.

9. Intellectual Property

All take offs, BOQs, spreadsheets, markups, 3D models and supporting documentation remain the intellectual property of Subbie Help Desk until payment has been received in full.

Upon payment, the client receives a non exclusive, non transferable licence to use the documents solely for preparing their own quotation or tender.

The documents must not be:

  • Resold
  • Shared with competitors
  • Distributed to third parties
  • Modified for commercial resale
  • Used to train or develop artificial intelligence or machine learning systems without prior written consent from Subbie Help Desk

10. Payment Terms

Unless otherwise agreed in writing:

  • Payment is required before work commences.
  • Work may be delayed where invoices remain unpaid.
  • Outstanding invoices must be paid before additional work is undertaken.
  • All prices are exclusive of GST unless otherwise stated.

11. Limitation of Liability

Subbie Help Desk’s total liability for any claim relating to the services provided shall be limited to the fee paid by the client for the relevant service.

Under no circumstances shall Subbie Help Desk be liable for:

  • Tender losses
  • Material shortages
  • Material over ordering
  • Construction delays
  • Loss of profit
  • Loss of opportunity
  • Indirect or consequential losses

The quantities supplied are intended solely as an estimating aid and must not be relied upon as the sole basis for procurement, pricing or construction.

The client is responsible for independently reviewing and verifying all quantities before relying upon them.

12. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

13. Acceptance

By accepting our quotation, instructing Subbie Help Desk to proceed, making payment or using any documents supplied by Subbie Help Desk, the client acknowledges that they have read, understood and accepted these Terms & Conditions.

Documents supplied by Subbie Help Desk are deemed delivered once emailed or otherwise electronically transmitted to the client.

The client is responsible for reviewing the documents promptly and notifying Subbie Help Desk of any concerns within a reasonable timeframe.

14. Professional Judgement & Assumptions

Where drawings, specifications or documentation are incomplete, inconsistent or unclear, Subbie Help Desk may use professional judgement and reasonable industry assumptions to complete the take off.

These assumptions are made solely to allow the quantity take off to be completed and should not be interpreted as design intent, engineering advice, construction advice, procurement advice or financial advice.

It is the client’s responsibility to review all assumptions and confirm them with the builder, architect, engineer or relevant consultant before relying on the quantities provided.

Where revised drawings or additional documentation become available after completion, Subbie Help Desk accepts no responsibility for any differences between the original take off and subsequent revisions unless specifically engaged to review and revise the take off.

All quantities, assumptions and documentation should be independently reviewed and verified by the client before ordering materials, submitting quotations or tenders, or commencing construction.
